1. What Is Jade AI and Its Limitations
Jade is an AI-powered digital assistant providing informational support on nutrition, fitness, and wellness via Telegram. Jade AI Nutritional Coach: • Is a fully automated AI system. • Is not a physician, registered dietitian, nutritionist, or licensed healthcare professional. • Does not provide diagnoses, medical advice, therapy, or prescriptions. • Generates responses based on data you provide and statistical models. • Provides information for general informational and educational purposes only, which does not substitute professional medical advice, diagnosis, or treatment. AI Transparency Notice: In accordance with ICO guidance on AI transparency, you are interacting with an artificial intelligence system, not a human. Responses are generated automatically and may contain inaccuracies. You should independently verify any health-related information before acting on it.
2. Eligibility and Permitted Use
You may use Jade AI only if you: • Are at least 16 years of age. We do not knowingly provide the service to users under 16. If we become aware that a user is under 16, their account and associated data will be deleted immediately. • Provide truthful and accurate information. • Use the service for personal, non-commercial purposes only. The following uses are strictly prohibited: • Using Jade AI as a substitute for professional medical, nutritional, or psychological advice. • Submitting third-party personal or health data without their explicit consent. • Using the service for any unlawful, harmful, or fraudulent purpose. • Attempting to reverse-engineer, scrape, or misuse the system. Voluntarily Submitted Health Data: By sharing information about medical conditions, medications, allergies, intolerances, or other health-related details, you acknowledge and provide explicit consent to the processing of such Special Category Data under Art. 9(2)(a) UK GDPR, as described in our Privacy Policy below.
3. Medical and Professional Disclaimer
For any sensitive or critical topic — including but not limited to medical conditions, eating disorders, pregnancy, post-surgical rehabilitation, intensive training programmes, or significant weight loss — you must always consult a qualified physician, registered dietitian, or licensed healthcare professional. Vivarium S.r.l. is not liable for any decisions made based on Jade AI's responses. Nothing in this service constitutes regulated medical advice under UK law.
4. Privacy and Data Protection
The processing of your personal data is governed by our Privacy Policy (Part II of this document), which you confirm you have read and understood upon activating the service. Right to Erasure: You may request deletion of your account and all associated personal data at any time by writing to [email protected]. Deletion will be carried out within 30 days of your request. If your account has been inactive for more than 6 months, all personal data will be automatically deleted.
5. Suspension and Termination
We reserve the right to suspend or terminate your access to Jade AI at any time, without prior notice, in cases of breach of these Terms, misuse or abuse of the service, or for technical, security, or legal reasons.
6. Intellectual Property
All content, software, design, trademarks, and branding associated with Jade AI Nutritional Coach are the exclusive property of Vivarium S.r.l. or its licensors. No rights are granted to you beyond the limited licence to use the service as described herein.
7. Limitation of Liability
The service is provided "as is" and "as available" without warranties of any kind, express or implied. To the fullest extent permitted by applicable law, Vivarium S.r.l. shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of, or inability to use, the service. Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015 or any other applicable UK consumer protection legislation. Our liability for death or personal injury caused by our negligence, or for fraudulent misrepresentation, is not excluded or limited.
8. Governing Law and Dispute Resolution
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, without prejudice to your rights as a consumer to bring proceedings in the courts of your country of residence within the UK.
9. Changes to These Terms
We reserve the right to update these Terms at any time. Material changes will be communicated via Telegram or email with reasonable notice before taking effect. Continued use of the service following notification constitutes your acceptance of the revised Terms.
